Universal Studios Hollywood Official Rules
October 1, 2018 – October 31, 2018

PRELIMINARY INFORMATION: 

No purchase necessary. A purchase or payment of any kind will not increase your chances of winning. The “Pass Member of the Month” (“Sweepstakes”) begins at 12:00 p.m. PT on October 1, 2018 and ends at 5:00 p.m. PT on October 31, 2018 (“Sweepstakes Period”). All times in the Sweepstakes refer to Pacific Time (“PT”).

ELIGIBILITY: 

The Sweepstakes is only open to permanent legal residents of the state of California and are active Universal Studios Hollywood Annual Pass or Season Pass members (“Passholders”)  who are eighteen (18) years or older as of 12:00 p.m. PT on October 1, 2018. Officers, directors, and employees of the Sweepstakes Entity (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as such persons (whether or not related thereto) are ineligible to enter or win the Sweepstakes. Any Annual Pass or Season Pass members who have won a sweepstakes within the last 90 days will be ineligible to enter this Sweepstakes.  The Sweepstakes Entity, as referenced herein, shall include USH (“Sponsor”), 100 Universal City Plaza, Universal City, CA 91608, and its respective parent, subsidiary, and affiliate companies, its administrative, advertising, and promotion agencies, and any other person or entity involved in the development, administration, promotion, or implementation of the Sweepstakes.

TO ENTER:

Your method of entry shall be as provided for in the Sweepstakes announcement, or if no method is described in such announcement, based upon the default instructions for each applicable social media channel as outlined below. No other method of entry will be accepted. Limit one (1) entry per person per Sweepstakes, regardless of method of entry. Additional entries beyond the specified limit will be void.

Instagram:

During the Sweepstakes Period, users can enter the sweepstakes by publicly posting a picture of themselves at Universal Studios Hollywood Park or on CityWalk using #UnistudiosAP (hashtag must be used in the post and privacy set to “Public”) on Instagram – only one (1) entry per guest.. Entries must be received by 5:00 p.m. on October 31, 2018 to be eligible for the Sweepstakes. Limit one (1) entry per person for the entire Sweepstakes Period. To enter any Sweepstakes via Instagram, you must have a valid public Instagram account and upload a qualifying photo (“Photo”) during the Entry Period containing appropriate descriptive text along with the hashtag provided in the Sweepstakes announcement. The official Universal Instagram account is located at the following address: www.instagram.com/UniStudios  All entries shall comply with the Instagram Terms of Use and Universal Terms of Use. Universal shall be permitted to post your entry on the Universal Facebook page and Instagram. All entries become the property of Universal and will not be acknowledged. If you do not have an Instagram account, visit www.Instagram.com and sign up in accordance with the registration instructions for a free Instagram account. Universal Instagram Sweepstakes winners will be notified by Instagram private message. Instagram may require you to respond to an authorization request if you are not already following the Universal Instagram channel. It is your obligation to ensure that your Instagram account is configured to receive private messages from the Universal Instagram account.

ENTRY AND TIMING:

Universal’s computer is the official time-keeping device for all Sweepstakes. Universal reserves the right to remove and/or disqualify any post/comment that is offensive, inappropriate, obscene, slanderous, or otherwise in conflict with the applicable social media platform terms and conditions or Universal’s Terms of Use . Multiple entrants are not permitted to share the same email account or social media account. Entries from social media accounts associated with businesses, organizations or groups, as well as bulk or listserv accounts are not permitted. Any attempt by any entrant to obtain more than a single entry by using multiple/different social media accounts, email accounts, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Entries that are generated by a script, macro, or use of any other automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email account used to register will be deemed to be the registrant or player. For entries via Instagram, “authorized account holder” is defined as the natural person who is assigned to each account by Instagram. Universal reserves the right to deem that the entry was made by the registered subscriber of the account at the time of entry. The potential winner may be required to show proof of being the authorized account holder.

WINNER SELECTION AND NOTIFICATION: 

The potential winner of the applicable giveaway will be selected by random drawing from among all eligible entries received for the applicable Sweepstakes promptly following the end of the applicable Entry Period. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winner will be declared the official winner of the applicable Sweepstakes. The decisions of Universal are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received for the applicable Sweepstakes. Limit one (1) Prize per person, family or household per Sweepstakes. The potential winner will be notified via private message on the applicable social channel. Potential winners are responsible for ensuring that their social media accounts are configured to receive private messages from each applicable Universal social channel. Potential winners may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”) within three (3) days of such notification. Noncompliance within this time period, with these Official Rules or the return of or inability to deliver any prize/prize notification may result in disqualification at Universal’s discretion. In the event that a potential winner is disqualified for any reason, or if winner cannot be reached, or prize notification is returned as undeliverable, Universal will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only one (1) alternate drawing will be held after which the prize(s) will remain un-awarded. Limit one (1) prize per family or household.

PRIZES:

There will be one (1) prize (“Prize”, collectively “Prizes”) awarded to one (1) winner, the Prize consisting of the following: Two (2) Universal Express™ tickets. Universal Express™ tickets do not include admission into the park, black-out dates will still apply, winner must be an active Pass Member.  Winner will be notified by email or phone on how to pick up Universal Express™ tickets. The approximate retail value of Prize is Two Hundred Ninety-Eight and 00/100 Dollars ($298.00). Exact Prize details shall be determined in the sole and absolute discretion of Universal. Prizes are non-transferable and non-assignable, with no cash redemptions except at Universal’s sole and absolute discretion. Universal reserves the right to substitute any Prize (or any portion thereof) with one of comparable or greater value at its sole and absolute discretion.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators: (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on www.instagram.com/UniStudios  and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes without additional compensation, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all actions of the Sponsors, whose decisions are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes.

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received at the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at (site page to come). Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules or acts 1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or 2) in any other disruptive manner (as determined by Sponsors in their sole discretion).

DISPUTES: The Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of CALIFORNIA, and the forum and venue for any dispute shall be in Los Angeles, CALIFORNIA. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in LOS ANGELES.  All proceedings brought pursuant to this paragraph will be conducted in the County of ORANGE.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. Any claims for bodily injury, personal injury, or property damage arising out of the redemption, use or misuse of any portion of the theme park element of the Prize must be submitted to the jurisdiction and venue of the federal and state courts of the State of California, and construed and enforced in accordance with the laws of the State of California.
